OVERVIEW
This website is operated by Atlas Paws Inc., Atlas Paws Two Inc., and Atlas Paws 3 Inc. (collectively, “ATLAS PAWS”). Throughout the site, the terms “we”, “us” and “our” refer to ATLAS PAWS. ATLAS PAWS offers this website, including all information, tools, retail products, and pet care services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing anything from us—including retail merchandise, online orders, daycare, boarding, grooming, or transport—you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein.
SECTION 1 - RETAIL & ONLINE STORE TERMS
- Eligibility: By agreeing to these Terms, you represent that you are at least the age of majority in your province of residence.
- Product Accuracy: We strive to display the colors and images of our retail products as accurately as possible, but we cannot guarantee your monitor's display will be exact.
- Billing: We reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases.
- Shipping: For online retail orders, risk of loss and title for items pass to you upon our delivery to the carrier.
SECTION 2 - PET CARE: HEALTH & VACCINATIONS
- Ownership: You represent that you are the legal owner of the dog(s) provided for Services.
- Health & Behaviour: You certify that your dog is in good health, free of communicable diseases, and has not harmed or shown aggressive behavior towards any person or dog in the past.
- Vaccinations: Dogs must be current on Rabies, DHPP, and Bordetella. A 7-day waiting period is required after vaccinations before entering the facility. You acknowledge that vaccines are not 100% effective and accept the risk of contagious conditions (e.g., Kennel Cough).
- Spay/Neuter: While we welcome all friendly dogs, we reserve the right to refuse service to intact dogs over 7 months if they exhibit behavior that disrupts the safety of the group.
SECTION 3 - ASSUMPTION OF RISK & BEHAVIOURAL MANAGEMENT
- Group Play Risks: ATLAS PAWS is a cage-free environment. You acknowledge that animal behaviour is unpredictable and voluntarily accept inherent risks, including but not limited to: bites, scratches, puncture wounds, ligament tears, parasites, and in rare circumstances, death.
- Management: Staff may use humane management techniques (verbal redirection, time-outs, leashing). We reserve the right to permanently expel any dog deemed unsuitable for the facility’s temperament.
SECTION 4 - MEDICAL EMERGENCIES & VETERINARY CARE
- Authorization: In the event of injury or illness, you authorize ATLAS PAWS to seek immediate veterinary care if you cannot be reached. You authorize us to contact your vet or use a vet of our choice.
- Financial Responsibility: You are solely responsible for all medical and veterinary costs incurred and agree to reimburse ATLAS PAWS for any expenses paid on your behalf before the dog is released.
- Senior Pets: We are not responsible for conditions triggered by age or pre-existing illnesses during the stress of grooming or boarding.
SECTION 5 - HEALTH, GROOMING & TRANSPORT POLICIES
- Grooming & Matting: If a coat is severely matted, our priority is your dog's humane care and comfort. We may shave the coat to prevent unnecessary pain. You release ATLAS PAWS from liability regarding skin irritation or "shave shock" resulting from this necessary care.
- General Health & Wellness: Because our guests love to play hard, occasionally bumps happen. Whether due to vigorous play, ear sensitivity, or excessive head-shaking, hematomas (swelling of the ear flap) and minor bruising can occur in active environments. By signing, you acknowledge these as inherent risks of social canine activity and release ATLAS PAWS from liability for these common occurrences.
- The "No-Romance" Policy: We love all our furry guests, but to keep the peace and prioritize safety, we are unable to accommodate female dogs currently in heat. We aren't equipped to manage the "lovestruck" environment that comes with this cycle! Please let us know if your pup is in season so we can help you reschedule her visit for when she’s back to her usual self.
- Transport (Bark Force One): You authorize ATLAS PAWS to transport your dog between locations or for pick-up/drop-off. You release ATLAS PAWS from liability in the event of an accident during transport, provided reasonable care was exercised.
- City Licensing: You assume full responsibility for City of Toronto bylaw infractions (e.g., licensing) while your dog is in public spaces with ATLAS PAWS.
SECTION 6 - LIABILITY WAIVER & INDEMNIFICATION (DOLA)
- Release: You hereby release ATLAS PAWS and its directors, officers, and employees from all liability, claims, or suits arising from the negligence of ATLAS PAWS or otherwise, to the fullest extent permitted by Ontario law.
- Statutory Liability (DOLA): You acknowledge that under the Dog Owners' Liability Act (Ontario), the owner of a dog is strictly liable for damages resulting from a bite or attack by the dog on another person or domestic animal. You agree that leaving your dog in the care of ATLAS PAWS does not shift this statutory liability to ATLAS PAWS.
- Indemnification: You agree to indemnify ATLAS PAWS from any claims, damages, or legal fees arising from your dog’s actions. If your dog injures another dog, person, or property, you acknowledge that you remain solely responsible both legally and financially.
SECTION 7 - ABANDONED PETS
Any dog not picked up within 7 days of the scheduled departure date, without communication from the Owner, will be considered abandoned. ATLAS PAWS will follow provincial protocols for abandoned animals, which may include transfer to local animal services or rescue.
SECTION 8 - MEDIA RELEASE
You grant ATLAS PAWS the exclusive right to use photographs or videos of your dog taken during their stay for marketing, social media, live webcams, and training purposes without compensation.
SECTION 9 - PAYMENT & CANCELLATIONS
- Retail: Payment for retail products is due at the time of purchase.
- Services: Service fees must be paid in full prior to the dog being released to your custody.
- Cancellations: Per our Refund Policy, standard bookings require 3 days' notice, and peak seasons require 7 days' notice. Late cancellations are subject to a fee of 50% of the service price.
SECTION 10 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
